WhoLeft — Terms of Use

1. Agreement

These Terms of Use ("Terms") are a binding agreement between you and Followers Unfollowers Tracker System LTD, 128 City Road, London, United Kingdom, EC1V 2NX ("we", "us", "our"). They govern your use of the WhoLeft mobile application for iOS and Android, the website wholeft.com and related services (the "Service").

WhoLeft uses only Instagram's official method to analyse your profile: the data export that Instagram itself provides to you. We never ask for your Instagram password, never log in to your account and never scrape Instagram.

WhoLeft is a trademark of Followers Unfollowers Tracker System LTD in the United States, the European Union and Brazil.

By downloading or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility. You must be at least 13 years old and old enough to use Instagram in your country. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or guardian, who accepts these Terms on your behalf and is responsible for any purchases.

2. The Service

WhoLeft analyses your Instagram follower data from official Instagram data exports and shows changes such as unfollowers, new followers, lost followers and accounts that do not follow you back. No registration or password is required: you add Instagram accounts to the app by entering their username. You can add several Instagram accounts and connect a separate Google Drive to each.

Manual mode. You request a data export from Instagram, download it and upload it to the app.

Automatic mode. You set up scheduled Instagram exports to your Google Drive and connect your Google account in the app. By connecting, you grant WhoLeft read-only access to your Google Drive. While Drive is connected, we use it only to request the folders containing Instagram exports created by Meta, about once a day, and analyse those exports, as described in the Privacy Policy. WhoLeft cannot create, edit or delete files in your Drive.

You can disconnect at any time by logging out of that Instagram account in the app, which deletes its data and revokes access, or by removing WhoLeft in your Google Account at Third-party apps with account access. Your use of Google services remains subject to Google's terms.

We never ask for your Instagram password and do not log in to Instagram on your behalf. Results depend entirely on the content and timing of the exports Instagram provides, which may be delayed, incomplete or changed by Instagram.

No affiliation. WhoLeft is not affiliated with, endorsed by or sponsored by Instagram, Meta Platforms, Inc., Google LLC or Apple Inc. All trademarks belong to their owners.

We may change, add or remove features at any time.

3. Subscriptions and Payments

Some features require a paid subscription. Prices, billing periods and any free trial are shown in the app before purchase.

Billing. Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
Auto-renewal. Subscriptions renew automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Free trials. If a trial is offered, any unused part of it is forfeited when you buy a subscription. If you do not cancel at least 24 hours before the trial ends, it converts to a paid subscription.
Cancellation. Cancel in your App Store or Google Play account settings. Deleting the app or logging out does not cancel a subscription. Access continues until the end of the paid period.
Refunds. Payments are processed by Apple or Google, and refunds are governed by their policies. Request a refund at reportaproblem.apple.com or through Google Play. Nothing in these Terms limits refund rights you have under local consumer law.
Price changes. We may change prices. Changes apply from your next billing period, with notice as required by Apple, Google or law.

4. Your Responsibilities

You may add only usernames of Instagram accounts that you own or are authorised to manage, and upload or connect only their data exports. We do not verify ownership of the usernames you add. You are responsible for keeping your device and Google account secure.

You agree not to:

use the Service to harass, stalk, monitor or harm any person;
upload exports that belong to someone else without their permission;
copy, resell, sublicense or commercially exploit the Service or its results;
reverse engineer, decompile or try to extract the source code, except where law allows;
interfere with, overload or bypass the security of our servers;
use bots, scripts or automated means to access the Service;
use the Service in breach of Instagram's or Google's terms or any applicable law.

The follower data in your exports includes information about other people. You must use the results only for your own personal, non-commercial purposes.

5. Intellectual Property and Third-Party Services

The Service, including the app, website, design, logos and the WhoLeft name, belongs to us or our licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal use, under these Terms and the rules of the App Store or Google Play.

Your export data remains yours. You give us a limited licence to store and process it only to provide the Service to you.

The Service relies on third-party services such as Instagram, Google Drive, Apple and Google. We are not responsible for their availability, changes or terms. If a third party changes or stops its export or API features, parts of the Service may stop working.

Apple-specific terms. These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple is not responsible for claims relating to the app, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

6. Creator Program

The WhoLeft Creator Program lets content creators earn money by promoting the app, for example by publishing content with our tag and app icon. Creators are paid based on verified views.

Applying. You apply through the form on wholeft.com. We may accept or reject any application at our discretion.
Agreement before publishing. Before publishing any content, you must agree the placement (platform, account and format) and the brief for each video with us. Only content that matches the agreed placement and brief is eligible for payment. Content published without this agreement, or that differs from the agreed brief, is not eligible for payment, including content where the WhoLeft name, tag or icon is simply added to unrelated material such as memes, clips or re-uploads.
Rates. Prices shown on the website are indicative only. The final CPM (rate per 1,000 views) and eligible platforms are agreed with each creator individually.
Payouts. You can request a payout at any time once your earnings reach at least $20 (USD). The number of views is fixed at the moment of your request and paid at the CPM agreed with you. We make the payout within 30 days of your request. Views included in a previous payout are not paid again.
Content rules. You must clearly disclose that your content is paid or sponsored (for example #ad), as required by the FTC, the UK ASA/CMA and local law. You must not make false or misleading claims about the app, including claims about features, Instagram or Meta, or use the app's name, icon or brand except as we allow.
Views. Only genuine, organic views count. Bought, botted or otherwise artificial views, or any fraud, cancel payment for the affected content and may end your participation.
Licence. You keep ownership of your content. You grant us a non-exclusive, worldwide licence to repost and reference it to promote WhoLeft, unless agreed otherwise.
Relationship. Creators are independent contractors, not our employees, agents or partners. You are responsible for your own taxes.
Changes. We may change or end the Creator Program at any time. Earned and verified amounts will still be paid.

Individual terms agreed with a creator prevail over this section.

7. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, including that the Service will be uninterrupted, error-free or that results will be accurate or complete. Analysis is based only on the data in Instagram's exports.

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or reputation. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or £50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law, including your statutory rights as a consumer.

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Service, to the extent permitted by law.

8. Termination, Law and Contact

Termination. You may stop using the Service at any time by logging out of your accounts and deleting the app; remember to cancel your subscription separately. We may suspend or end your access if you breach these Terms or if required by law.

Governing law. These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer you may also bring proceedings in the courts of your country of residence, and you keep the protection of its mandatory consumer laws.

Changes. We may update these Terms. We will post the new version with a new "Last updated" date and notify you in the app of material changes. Continuing to use the Service after changes take effect means you accept them.

General. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor business.
